Summary Of The Case Studies
Jürgen complained about his bank after he discovered that it had been sending bank statements to the address of Jürgen’s abusive ex-partner for several months. Jürgen found out about this after he asked the bank for copies of bank statements as part of ongoing divorce proceedings. When the bank statements were presented, Jürgen was shocked and extremely upset to find the ex-partner’s address on the account, meaning they had seen several weeks’ worth of Jürgen’s transactions. Jürgen said they had been harassed by calls, text messages and emails from their ex-partner over the last few weeks and couldn’t understand how they got Jürgen’s new contact details. This was a difficult and depressing time for Jürgen, and added stress came when Jürgen realized that they now had to change their address, telephone number and email address. Although Jürgen and her ex-partner previously had a joint account, this was converted into an individual account. However, due to human error at the bank, the correspondence address was not changed from that of Jürgen’s ex-partner. The bank apologized for the mistake – acknowledging the data breach – and offered compensation, but Jürgen was not satisfied with their response and asked us to investigate the incident.
*Jürgen was shocked when he found out that his ex-partner’s address was registered on his account
*Emotional damage from the bank to Jürgen
*Jürgen does not accept the bank proposal
The Problems Being Encountered of the Case
We asked Jürgen to tell us more about the impact we felt after learning that the bank had sent bank statements to the ex-partner. Although we recognized that the bank had apologized and corrected the correspondence address in its system, we did not believe that the bank had fully taken into account the distress Jürgen had suffered as a result of its error. And we said that the compensation offered as an apology was not enough. The increased contact from Jürgen’s partner came at a time when Jürgen thought they had put their abusive relationship behind them and were moving on with their lives. We have arranged a meeting with the bank to discuss compensating Jürgen for the damage caused. Bank was happy to meet us as she didn’t want to let us take the case to court. We don’t always take cases to court, but rather ensure that our clients are satisfied with the best possible solution.

Arrange a meeting with the bank so we can discuss the Jürgen case.
Take the bank to court for the damage they caused to Jürgen.
Jürgen pardon the bank mistake and fix the account’s address.
The Outcome of the Lawsuit
In the circumstances we felt that 1,500 euro compensation would better reflect the distress and inconvenience the error had caused. Both Jürgen and the bank accepted this, and the bank agreed to make their payment to Jürgen.
